Effective December 23, 2009, CMS determines that the evidence is adequate to conclude that outpatient intravenous insulin therapy (OIVIT) does not improve health outcomes in Medicare beneficiaries and is not reasonable and necessary under section 1862(a)(1)(A) of the Social Security Act. Therefore, services OIVIT and services comprising and OIVIT regimen are nationally noncovered by Medicare. This revision is a national coverage determination (NCD). NCDs are binding on all carriers, fiscal intermediaries,[contractors with the Federal government that review and/or adjudicate claims, determinations, and/or decisions], quality improvement organizations, qualified independent contractors, the Medicare appeals council, and administrative law judges. An NCD that expands coverage is also binding on a Medicare advantage organization. In addition, an ALJ may not review an NCD.
